USER TERMS AND CONDITIONS – PART A

1. Definitions

"Company" refers to THE FORTTUNA EVENTS ORGANIZING & MANAGING CO. L.L.C, the entity curating the Forttuna Global 100, registered in Dubai, UAE.

"Forttuna Global 100" (FG100) refers to the Company’s flagship magazine and recognition vertical that features selected leaders, innovators, and professionals in global magazines, publications, and digital platforms.

"Participant" refers to any individual or entity whose profile is nominated, selected, or featured in Forttuna Global 100.

2. Nomination & Selection

Participants may apply directly or be nominated by third parties. The Company reserves the right to accept, shortlist, or decline nominations at its sole discretion. All information provided by Participants during the nomination/application process must be accurate and up-to-date.

3. Participation

Selected Participants agree to maintain professionalism, integrity, and respectful conduct throughout their association with Forttuna Global 100. The Company reserves the right to revoke recognition or restrict participation if a Participant engages in misconduct, misrepresentation, or activities that may harm the reputation of the Company.

4. Intellectual Property

All editorial materials, layouts, branding, digital assets, and content curated by the Company are protected under intellectual property laws. Unauthorized use, reproduction, or distribution of Forttuna Global 100 materials without prior written consent is strictly prohibited.

5. Media Consent

Participants acknowledge that the Company may capture photographs, videos, editorial content, or digital materials for use in magazines, online platforms, or promotional campaigns. By participating, Participants grant the Company the right to use such content for editorial, marketing, and publicity purposes.

6. Liability

The Company shall not be held liable for any loss, injury, or damage (direct or indirect) sustained by Participants during their association with Forttuna Global 100, including but not limited to recognition activities, features, or events. Participants are solely responsible for their professional conduct and decisions.

7. Cancellation, Rescheduling, Postponement, and Prepone by Forttuna Global 100

Cancellation: The Company reserves the right to cancel any planned feature, editorial, or event under Forttuna Global 100 due to editorial discretion, logistical challenges, or unforeseen circumstances. Participants will be informed promptly.

Rescheduling: Features or publications may be rescheduled. Participants will be notified, and their inclusion will be automatically carried forward to the revised schedule.

Postponement: If a publication or recognition program is postponed, Participants will be informed of the new date. Alternative options may be provided at the Company’s discretion.

Prepone: In exceptional cases, a release or feature may be preponed. Participants unable to align with the new timeline will be offered alternatives as determined by the Company.

Refund Policy: Editorial participation or recognition fees (if applicable) are non-refundable. Any refunds for special circumstances will be considered solely at the Company’s discretion.

Limitation of Liability: The Company will not be responsible for any travel, accommodation, or other costs incurred due to cancellation, postponement, or schedule changes.

8. Modifications

The Company reserves the right to modify Forttuna Global 100 programs, editorial features, activities, or Terms & Conditions without prior notice. Participants are advised to review the official website for updates.

NON-DISCLOSURE AGREEMENT (NDA)

1. Parties

This Agreement is entered into by and between THE FORTTUNA EVENTS ORGANIZING & MANAGING CO. L.L.C (“Company”) and the registered/featured participant of Forttuna Global 100 (“Participant”).

2. Confidential Information

Confidential Information includes, but is not limited to, editorial drafts, unpublished media, proprietary resources, trade secrets, or sensitive data shared with Participants during the Forttuna Global 100 process.

3. Obligations

Participants agree to maintain confidentiality of all information obtained through Forttuna Global 100. Such information may not be disclosed, reproduced, or distributed without prior written consent of the Company.

4. Duration

The obligations of confidentiality shall remain in effect indefinitely from the date of participation.

5. Exceptions

The obligations shall not apply to information that:

* Was already known to the Participant prior to disclosure,

* Becomes public without breach of confidentiality, or

* Is lawfully obtained from a third party.

6. Remedies

Unauthorized disclosure of Confidential Information may cause irreparable harm. The Company reserves the right to pursue legal remedies, including injunctive relief, against breaches.

7. Agreement

By submitting nominations, providing details, and/or participating in Forttuna Global 100, the Participant acknowledges, understands, and agrees to the Terms & Conditions of this Non-Disclosure Agreement.

USER TERMS AND CONDITIONS – PART B

Forttuna Global 100 provides a recognition and editorial platform for global leaders, innovators, and professionals. By submitting an application or agreeing to be featured, the Participant acknowledges and agrees to the following:

* Information provided, including achievements, credentials, and supporting documentation, may or may not be independently verified by the Company.

* Participants agree to indemnify and hold harmless the Company, its affiliates, and representatives from any claims, liabilities, or damages arising from false or misleading information provided.

* The Company relies on submitted information for editorial and recognition purposes and does not guarantee its accuracy or authenticity.

* Participants assume all risks associated with their submissions and the publication of such information in Forttuna Global 100 features, online or print.

* The Company reserves the right to reject, edit, or disqualify any application or profile at its sole discretion.

* Recognition or inclusion in Forttuna Global 100 does not guarantee speaking slots, media coverage, or additional benefits unless explicitly stated by the Company.

* Editorial/recognition fees (where applicable) are non-refundable, except under extraordinary conditions determined by the Company.

* Participants are required to uphold professionalism, authenticity, and ethical standards in all interactions with Forttuna Global 100.

* The Company reserves the right to modify editorial guidelines, features, and benefits as deemed necessary.

* All decisions by the Company regarding selection, editorial inclusion, or recognition are final and binding.
